Your tenant cannot prevent you from selling your apartment
Many owners do not even think of selling their apartments as long as they are rented out, believing that they cannot sell their properties when occupied by a tenant.
1. An apartment can be sold while occupied by a tenant. If a piece of real property is rented out, the new owner of the property must agree to the valid contract of tenancy, but the contract cannot hinder the sale itself.
2. The property can be viewed According to §1 act 6 section 340 of the Hungarian Civil Code, the tenant is required to provide access to the apartment to persons who are interested in acquiring the property. The law, of course, also stipulates that the viewing of the apartment must take place "without unduly disturbing" the tenant.
3. What if the buyer insists on an empty apartment? As a tenancy cannot be terminated due to the existence of a lease agreement - unless such possibility was stipulated within the contract - the only possibility left is for the parties to come to an agreement. In that case, the parties must find and stipulate those conditions and circumstances that can be agreed to by both parties, and such terms must be stipulated in the agreement.
